These Terms of Service ("Terms") govern your access to and use of the website at fein.vc (the "Site") and any related services we offer through it (together, the "Services"), provided by fein ("fein", "we", "us", or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who may use the Services
You may use the Services only if you can form a binding contract with us and are acting on behalf of a business. If you use the Services for an organisation, you represent that you are authorised to accept these Terms on its behalf.
2. The Services
The Site describes fein, our software for venture capital teams, and lets you learn about it and contact us. The fein software is open source and is intended to run on your own infrastructure. Your use of that software is governed by the open-source licence that accompanies its source code, not by these Terms. These Terms govern the Site and the sales and support activity around it.
3. Enquiries and communications
When you submit the "Talk to sales" form, you may receive messages from us in response, including to arrange a call. You are responsible for the accuracy of the information you provide. Our handling of that information is described in our Privacy Policy.
4. Acceptable use
When using the Site, you agree not to:
- break any applicable law or regulation, or infringe anyone's rights;
- attempt to gain unauthorised access to the Site, its systems, or other users' data;
- interfere with or disrupt the Site, including by introducing malware or overloading it;
- scrape, harvest, or collect information from the Site except as permitted by us; or
- submit false, misleading, or spam content through our forms.
5. Intellectual property
The Site, including its text, design, graphics, and layout, is owned by us or our licensors and is protected by intellectual property laws. The name "fein" and our logo are our trademarks, and you may not use them without our prior written permission. Except for the open-source software described above, nothing in these Terms grants you any right to our intellectual property.
6. Commercial terms
Any paid engagement, such as a build and ongoing service, is subject to a separate written order or agreement between you and us that sets out scope, fees, and payment terms. Pricing shown on the Site is indicative and may change. If there is a conflict between these Terms and a signed order, the signed order controls for that engagement.
7. Third-party services
The Site relies on and may link to third-party services. We are not responsible for third-party services, and your use of them is subject to their own terms.
8. Disclaimers
The Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on it is complete or current.
9. Limitation of liability
To the fullest extent permitted by law, fein will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred pounds sterling (GBP 100). Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnification
You agree to indemnify and hold harmless fein and its personnel from any claims, losses, and expenses arising out of your misuse of the Site or your breach of these Terms.
11. Changes to the Site and these Terms
We may change or discontinue the Site, and we may update these Terms from time to time. When we update them, we will revise the "Last updated" date above. Your continued use of the Site after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute relating to them, subject to any mandatory rights you have under the law of your country of residence.
